Terms of Service

1. Acceptance of terms
By accessing or using Bitrize's services, website, APIs, or any related products (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Services on behalf of an organization, you are agreeing to these Terms on behalf of that organization.
If you do not agree to these Terms, you must not access or use the Services.
2. Description of services
Bitrize provides AI-powered data management tools including autonomous database agents, natural language query engines, smart data pipelines, and related analytics services. The Services are provided on a subscription basis as described in the applicable order form or pricing page.
3. Account terms
- You must provide accurate and complete registration information.
- You are responsible for maintaining the security of your account credentials.
- You must notify us immediately of any unauthorized access to your account.
- You may not use the Services for any illegal or unauthorized purpose.
- You are responsible for all activity that occurs under your account.
- One person or legal entity may not maintain more than one free account.
4. Acceptable use
You agree not to misuse the Services. Prohibited activities include but are not limited to:
Reverse engineering or decompiling the platform
Attempting to access other users' data
Using the service for cryptocurrency mining
Sending spam or unsolicited communications via the platform
Circumventing usage limits or rate limits
Submitting malicious code or payloads to the platform
5. Payment and billing
Subscription fees
Paid plans are billed in advance on a monthly or annual basis. Fees are non-refundable except as required by applicable law or as expressly stated in these Terms.
Price changes
We may modify pricing with 30 days advance notice. Price changes take effect at the start of your next billing cycle.
Taxes
Fees are exclusive of taxes. You are responsible for all applicable taxes unless you provide a valid tax exemption certificate.
6. Intellectual property
Our IP
The Services, including all software, algorithms, models, designs, and documentation, are the property of Bitrize and are protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the Services as described herein.
Your content
You retain all rights to your Content. By submitting Content to the Services, you grant Bitrize a limited license to process, store, and display your Content solely to provide the Services. We do not claim ownership of your data.
7. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BITRIZE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL.
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO BITRIZE IN THE 12 MONTHS PRECEDING THE CLAIM.
8. Service Level Agreement
For paid plans, we commit to the following service levels:
Uptime
Target: 99.9%
Credit: 10% for each 0.1% below
API Response
Target: < 200ms (p95)
Credit: 5% credit
Support Response
Target: < 4 hours (business)
Credit: Case-by-case
9. Termination
By you
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period.
By Bitrize
We may terminate or suspend your access to the Services at any time if you violate these Terms. We will provide notice and an opportunity to cure, except in cases of egregious violations.
Data export
After termination, you have 30 days to export your data. After that period, we will delete your data in accordance with our Privacy Policy.
10. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the state or federal courts located in San Francisco County, California.
